1. Store Operator

The MoonlightSeekers.com online store (the "Store") is operated by Feel Good Faktory, Montréal, Québec, Canada. By making a purchase, you agree to these Store Terms and our Shipping & Returns Policy.

2. Products and Pricing

2.1 Product Descriptions

We make reasonable efforts to display products accurately. Slight variations in colour or texture may occur and do not constitute grounds for a return unless the product is materially different from its description.

2.2 Pricing

All prices are in Canadian dollars (CAD) and include applicable taxes for Canadian orders. The price at the time of order confirmation is the price you will be charged.

2.3 Taxes

Orders shipped within Canada are subject to applicable federal and provincial sales taxes (GST, HST, or GST + QST). Orders shipped outside Canada are sold tax-free; the buyer is solely responsible for any import duties or local taxes imposed by their country.

2.4 Availability

All products are subject to availability. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund for that item.

3. Orders and Payment

3.1 Order Confirmation

Submitting an order constitutes an offer to purchase. A binding contract is formed only when we send an order confirmation by email. We reserve the right to refuse or cancel any order, including where pricing errors have occurred.

3.2 Payment

Payments are processed securely through Square. We accept major credit and debit cards, Apple Pay, and Google Pay. We do not store your full payment card details. 3.3 Concert Pickup Orders

Customers who select the Concert Pickup option receive a 15% discount and normally collect their order at a Moonlight Seekers concert. If you are ultimately unable to attend, you may request that your order be shipped to you instead — your discounted price is honoured, and standard shipping fees will be added. 3.4 Order Changes

Once an order is placed, we cannot guarantee changes or cancellations as orders may begin processing immediately. Contact us as soon as possible at [email protected].

4. Right of Withdrawal — Québec Consumer Protection Act

This right applies to Québec residents under the Consumer Protection Act (CQLR c P-40.1). It is separate from our general returns policy described in the Shipping & Returns Policy.

If you reside in Québec, you have the right to cancel a distance contract within seven (7) days of physically receiving the goods, without giving any reason. To exercise this right:

Return the items in their original, unworn, unwashed condition in original packaging.
Return shipping costs are your responsibility, unless the item is defective or was incorrectly described.
We will acknowledge your request within 15 days and issue a full refund within 15 days of receiving the returned goods.

Certain items are excluded from this right: final-sale items, digital downloads already delivered, and custom-made items.

5. Personal Information and Communications

Your personal information is handled in accordance with Québec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25). By placing an order, you consent to receiving transactional emails related to that order. If you have subscribed to our newsletter, you may withdraw consent at any time by clicking "Unsubscribe" in any email or by contacting us at [email protected], in accordance with Canada's Anti-Spam Legislation (CASL).

6. Disclaimers and Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY PURCHASE-RELATED CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS IN QUESTION. WE SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.

Nothing above limits any rights you have under the Québec Consumer Protection Act or other mandatory consumer legislation.

7. Modifications and Governing Law

We may update these Terms with 15 days' notice. They are governed by the laws of Québec; any dispute shall be submitted to the courts of the judicial district of Montréal. Québec consumers may also contact the Office de la protection du consommateur (OPC).
